In this respect, it is stated that the doctrine of lis pendens as stated under section 52 of the Transfer of Property Act is applicable, according to which the filing of the suit serves as a constructive notice to the public that a claim over the property has been filed by the party to the lis.
Therefore this court does not deem fit to grant ex-parte interim stay at this stage without hearing the opposite party.
